MySwimPro Privacy Policy

Last updated . See the changelog for what changed.

We at MySwimPro, Inc. (“MySwimPro”) have created this privacy policy (this “Privacy Policy”) because we know that you care about how information you provide to us is used and shared. This Privacy Policy relates to the information collection and use practices of MySwimPro in connection with our Services, which are made available to you through the Platform. By visiting our Website and/or using our Services on the Platform, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Use.

The Information We Collect

1. Personal Information

When you sign up to become a Registered User, enter any promotion, contest, or sweepstakes, or sign up for our newsletter or other publications, you will be required to provide us with personal information about yourself, which may include your name, address, e-mail address, and phone number. If you elect to sign in to the Platform using a third-party sign-in service such as Apple, Google or Facebook, you are authorizing MySwimPro to collect, store, and use, in accordance with this Privacy Policy, the information that you agreed that service could provide to MySwimPro through its Application Programming Interface (“API”). Such information may include, without limitation, your first and last name, profile picture, unique identifier and access token, and e-mail address. All information collected pursuant to this section is collectively referred to as “Personal Information.” We do not collect or access any Personal Information from you when you use the Services unless you provide us with the Personal Information voluntarily or authorize us to access it.

2. Other Information

We may collect additional information (collectively, the “Other Information”). Such Other Information may include:

Accessing and Modifying Personal Information and Communication Preferences

If you have registered for the Platform, you may access, review, and make changes to your Personal Information, and certain Other Information by following the instructions found on the Platform. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any MySwimPro marketing email. We will use commercially reasonable efforts to process such requests in a timely manner. Registered Users cannot opt out of receiving transactional e-mails related to their account.

How We Use and Share the Information

We use the Personal Information, and the Other Information (collectively, the “Information”) to provide and improve the Platform and the Services, process transactions, solicit your feedback, administer our rewards, contests, and promotional programs, inform you about our products and services, and in other ways described below, as allowed by law.

Apple HealthKit

Data we receive from Apple's HealthKit, such as swims you recorded on Apple Watch, is used to provide MySwimPro to you. We never use it for advertising or marketing, never sell it, and never share it with data brokers or advertisers. We share it with a third party only when you ask us to, by connecting a service to your account and choosing to share your swims with it: for example, syncing a swim to Strava, or asking an AI assistant you have connected about your training. Each of those connections is yours to turn off (see Connected Apps and AI Assistants). Deleting a swim from MySwimPro does not delete it from Apple Health, and the reverse is also true.

Sharing on the Platform and with other users

Unless otherwise marked “private” through the functionality of the Platform, any data and/or content that you post to the Platform will be publicly viewable on the Platform and shareable by other users. Likewise, anything that you post to a social account via the Platform will be viewable and accessible on that social account as if you had posted it there directly. With your permission, we may share your Personal Information, and certain Other Information with other Registered Users in your personal network whom you designate as having the right to view such information. You may change such designations at any time by following the instructions on the Platform.

Sharing with other companies

We may from time to time share Personal Information, and/or Other Information with other companies who may provide you information about the products and services they offer. However, to the extent required by law, you will be given the opportunity to opt-out of such sharing. In an ongoing effort to better understand our users and our Platform and Services, we might analyze the Other Information in aggregate form in order to operate, maintain, manage, and improve the Services and/or Platform. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products, Platform, and Services to current and prospective business partners and to other third parties for other lawful purposes. We may employ other companies and individuals to perform functions on our behalf. Examples may include providing marketing assistance, information technology support, and customer service. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.

Third-party apps and services you connect

If you connect a third-party app or service to your MySwimPro account, we share the information that connection needs with it. This includes fitness platforms you sync swims to, such as Strava, TrainingPeaks and Garmin, and AI assistants you authorize, such as Claude or ChatGPT. We use standard OAuth (open authorization) for this, so you can give an app permission to use your account without sharing your password. You choose what each connection can access when you connect it, and you can disconnect it at any time. Once your data reaches a connected service, that service's own privacy policy governs how it is used and kept. See Connected Apps and AI Assistants.

Business transfers and legal requirements

As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets. To the extent permitted by law, we may also disclose Information when required by law, court order, or other government or law enforcement authority or regulatory agency, or whenever we believe that disclosing such information is necessary or advisable, for example, to protect the rights, property, or safety of MySwimPro or others.

Connected Apps and AI Assistants (Claude, ChatGPT and Others)

You can connect AI assistants and other apps to your MySwimPro account so they can answer questions about your training and build workouts for you. This section explains what that connection shares and how to end it.

You choose the access

When you connect an app, MySwimPro shows you a consent screen listing what it is asking for. You can grant all of it or only some. The possible permissions are:

Writing to your account

An app with the workout permission can create a workout in your library or change one that is already there. Our connector refuses those changes unless the assistant has confirmed the specific change with you first: the assistant asks you, then tells us you agreed. Everything else an app can do is read-only.

What reaches us, and what does not

When you ask an assistant about your swimming, it sends MySwimPro a specific request, for example “list this swimmer's workouts from last week”, and we return only that data. We never receive your conversation with the assistant, your other messages, or anything you tell it that is not a request for your MySwimPro data. For security and troubleshooting we record which request was made and when, and whether it succeeded. We do not attach your IP address, request headers or cookies to those records.

Once the data reaches the assistant, its provider's policy applies

We do not control how Anthropic, OpenAI or any other provider stores, uses or retains what you share with their product, including whether it is used to improve their models. Those choices are made in your account with that provider. Please read their policies before connecting: Anthropic's privacy policy (Claude) and OpenAI's privacy policy (ChatGPT).

How long a connection lasts

A connection stays active while the app uses it. The credential an app uses to act for you expires after one hour and is renewed automatically while you keep using the app. If an app has not been used for 30 days, its connection expires on its own and it has to ask you again.

How to disconnect

Sign in at app.myswimpro.com/account, find “Connected Apps”, and choose Disconnect next to the app. Its access ends immediately. You can also remove MySwimPro from the app's own settings (for Claude, under Connectors; for ChatGPT, under Apps), or email privacy@myswimpro.com and we will disconnect it for you. Deleting your MySwimPro account disconnects every app. Disconnecting does not remove data the app already received; ask the provider to delete that.

How We Protect Your Information

We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet. In particular, e-mail sent to or from the Platform may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Protection of Certain Personally Identifying Information

MySwimPro discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on MySwimPro's behalf or to provide services available at MySwimPro's websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using MySwimPro's websites, you consent to the transfer of such information to them. MySwimPro will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, MySwimPro discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when MySwimPro believes in good faith that disclosure is reasonably necessary to protect the property or rights of MySwimPro, third parties or the public at large. If you are a registered user of a MySwimPro website and have supplied your email address, MySwimPro may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what's going on with MySwimPro and our products. We primarily use our various product blogs to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. MySwimPro takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

How Long We Keep Your Data

While you have an account

We keep your account details, profile, swims, workouts, training plans and settings for as long as your account exists, so your history is there when you come back.

When you delete your account

You can delete your account yourself in the app's settings or at app.myswimpro.com/account, or by emailing privacy@myswimpro.com from your account's email address. Deletion starts immediately and removes your personal information from our active systems, including every connected app's access, usually within minutes. We then ask the service providers that hold copies, such as our analytics and subscription providers, to delete their copies; they complete this within 30 days. We keep one record that a deletion was requested, holding only your former account identifier, the date, and whether it completed, so we can confirm to you that it was done and stop any process that was still running from writing data for a deleted account.

Backups

Our database is backed up regularly and backups are kept for a limited period, after which deleted data ages out of them as well. Backups are used only to recover from a failure and are never restored selectively to bring back one person's data.

Logs

Server logs, which include IP addresses, request times and error details, are kept for 30 days. Error reports in our monitoring tools are kept for 90 days.

Connected apps

The credentials an app you connect uses to act for you expire after one hour (access) and after 30 days without use (renewal), and expired credentials are purged every hour. See Connected Apps and AI Assistants.

Payments

Your purchases are processed by Apple, Google, Stripe or RevenueCat. We keep purchase records for as long as tax and accounting law requires, which is typically seven years, and they are the only data we keep that long after an account is deleted.

Children

We do not knowingly collect Personal Information from children under the age of 13 through the Platform. If you are under 13, please do not give us any Personal Information. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children to never provide Personal Information through the Platform without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information to us, please contact us, and we will endeavor to delete that information from our databases.

Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. By accessing the Platform and/or using the Services after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the information. Please refer back to this Privacy Policy on a regular basis.

How to Contact Us

If you have questions about this Privacy Policy, please e-mail us at privacy@myswimpro.com or follow the instructions on the Platform.

Data Deletion or Download Requests

Account data can be deleted or downloaded upon request in your account settings at app.myswimpro.com/account, in the MySwimPro mobile app settings, or by emailing us at privacy@myswimpro.com from the email associated with that account. See How Long We Keep Your Data for what happens next.
